Terms of Service

These Terms of Service ("Terms") govern your use of getuntethrd.com, our free tools (including the Exit Multiple Estimator and any other calculators or assessments we publish), and, at a high level, our paid services. If you become a paying client, your engagement is also governed by a separate signed agreement (Client Services Agreement for Done For You, or a Concierge Agreement for Concierge), which controls over these Terms wherever the two conflict.

By using our website or tools, or by paying for our services, you agree to these Terms. You must be at least 18 years old to use our website or tools.

1. Who We Are

untethrd is operated by ICK Ventures LLC, an Indiana limited liability company ("untethrd," "we," "us," "our"). We act as a fractional operations partner for owner-operated businesses: we find the operational constraint costing an owner the most and install and run the system that removes it.

2. Free Tools and Estimates

Tools like the Exit Multiple Estimator provide illustrative, non-binding estimates based on general industry comparables and the information you enter. They are provided for informational purposes only, do not constitute financial, legal, valuation, or investment advice, and should not be relied on as a substitute for a professional business valuation. Actual results for any specific business depend on its own financials, buyer, and market conditions at the time of any transaction.

3. The Free Operations Audit Call

Booking a free Operations Audit call does not create any obligation for you to purchase services, and does not create any contractual relationship between us beyond the call itself. Information you share on the call may be used to personalize our follow-up communication with you, as described in our Privacy Policy.

4. Paid Services

If you engage us as a client, the scope of services, pricing, term, and other material terms are set out in your signed agreement (Client Services Agreement or Concierge Agreement, as applicable). Payment is collected through Stripe. By completing a payment through Stripe, you confirm that you have read and agree to these Terms, our Privacy Policy, and your signed agreement.

5. Intellectual Property

Our website and content. The content on getuntethrd.com, including copy, design, our free tools, and our brand assets, is owned by untethrd and may not be copied, reproduced, or used commercially without our written permission.

Systems built under a client engagement. Ownership of any system, software, or automation involved in a client engagement is governed exclusively by that client's signed agreement, not by these Terms, and depends on which engagement type it is: untethrd retains ownership of systems it builds under a Done For You engagement, while a Client retains ownership of systems Client builds under a Concierge engagement. In both cases, clients own their own underlying business data at all times.

6. Acceptable Use

You agree not to use our website or tools to:

• Violate any law
• Attempt to gain unauthorized access to our systems
• Scrape, copy, or republish our content or tools without permission
• Submit false information with intent to misuse our free tools or booking process

7. Disclaimers

Our website, free tools, and the free Operations Audit call are provided "as is" without warranties of any kind, express or implied. We do not guarantee that any estimate, projection, or outcome discussed on a call or generated by a free tool will reflect your actual results.

8. Limitation of Liability

To the maximum extent permitted by law, untethrd and ICK Ventures LLC are not liable for any indirect, incidental, special, or consequential damages arising from your use of our website, free tools, or the free Operations Audit call. If you become a paying client, liability for paid services is governed separately by Section 11 of your signed agreement (Client Services Agreement or Concierge Agreement, as applicable).

9. Termination of Website/Tool Access

We may restrict or terminate your access to our website or free tools at any time, for any reason, particularly in cases of misuse.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles.

Before starting arbitration, please try to resolve the dispute informally by contacting us at hello@getuntethrd.com; we'll attempt in good faith to resolve it within 30 days.

Any dispute arising out of or related to these Terms that isn't resolved informally will be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, before a single arbitrator, seated in Indiana, rather than in court. You and untethrd each waive the right to a jury trial and to bring or participate in any class, collective, or representative action against the other; all claims must be brought individually. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) may proceed in court, and the rest of this Section 10 remains in effect for all other claims. This does not prevent either party from seeking injunctive relief in court to protect intellectual property, or from bringing an individual claim in small claims court where it qualifies.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or tools after changes take effect constitutes acceptance of the updated Terms.

12. Accessibility

We're committed to making our website accessible to everyone, including people with disabilities, and we aim to meet the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. 13. California Consumer Rights Notice
